Electronic monitoring is a form of digital incarceration, often in the form of a wrist bracelet or ankle “shackle” that can monitor a subject’s location, and sometimes also their blood alcohol level or breath.

Monitors are commonly used as a condition of pretrial release, or post-conviction supervision, like probation or parole. They are sometimes used as a mechanism for reducing jail and prison populations. Electronic monitoring has also been used to track juveniles, immigrants awaiting legal proceedings, adults in drug rehabilitation programs, and individuals accused or convicted of DUIs or domestic violence.

Typically, people on monitors must charge their devices daily and can’t leave their homes without permission, and/or have areas of the city, called exclusion zones, where they’re not allowed to visit without triggering an alarm. Some counties require as much as a full week’s notice for a schedule change, even in the event of an emergency. Some counties impose installation fees and daily fees for the devices and require users to own a landline phone. If the device disconnects, the monitored person may be incarcerated.

Electronic monitoring has seen a 140 percent increase in just over a decade. About 125,000 devices are in use, with up to 30,000 of them attached to immigrants on any given day. States with the most prolific use of electronic monitoring include Florida, Texas, California, Massachusetts, and Michigan.

Not only does electronic monitoring impose excessive surveillance on people coming home from prison, but it also hinders their ability to successfully transition back into the community. Additionally, there is no concrete evidence that electronic monitoring reduces crime rates or recidivism.

How Electronic Monitoring Works

Electronic monitoring devices typically use active or passive GPS tracking, radio frequency monitoring, secure continuous remote alcohol monitoring, or breathalyzer monitoring.

Active GPS tracking uses satellites to triangulate and transmit location information at set intervals.

Passive GPS tracking tracks and stores location information for download at a later time.

Radio frequency is used for curfew monitoring. A home monitoring unit detects the monitor within a specific range and sends confirmation back to a monitoring center.

Secure Continuous Remote Alcohol Monitoring, or SCRAM, analyzes perspiration to send a blood alcohol content report every hour.

A breathalyzer monitor usually has a camera. It tests a subject’s breath at random to estimate their blood alcohol content.

How Law Enforcement Uses Electronic Monitoring

All 50 states use some form of electronic monitoring. Sometimes it is used pretrial or during trial, for people who have been arrested but have not been convicted of any crime. It can be used post-conviction, either before or after serving a sentence of incarceration. It’s been used for people on probation or parole, or who are under community supervision after serving time in jail or prison.

Every state except New Hampshire uses some form of juvenile electronic monitoring. It’s also been used on immigrants, who are placed under the electronic supervision of Immigrations and Customs Enforcement (ICE).

Even though electronic monitoring is a form of custodial detention, not everyone on it receives credit for time served on the monitor.

People subject to electronic monitoring often pay user fees ranging from $3 to $35 per day, along with $100 to $200 in setup charges. This unfairly shifts the costs of incarceration from the government to individuals and their families. A class-action lawsuit in Alameda County alleges that this practice amounts to extortion.

Electronic monitoring can make it difficult for parolees or probationers to go to job interviews, access employment and education, receive medical treatment, responsibly parent their children, or take part in family and community life. Short perimeters around their homes can stop people from emptying their garbage or doing yard work. Exclusion zones may prevent people from visiting homes of family members, religious services, school, or work.

Responding to emergencies can be difficult, too. A person may be forced to take the risk of going back to prison for unauthorized movement to get a sick child to the hospital, or to pick up an elderly family member during bad weather.

Electronic monitoring can interfere in employment activities. It can create challenges for landscaping, construction, or delivery jobs. Some buildings, such as warehouses, interfere with GPS signals, so people may need to leave work to pick up the signal or call their parole officers. Unplanned overtime or a sudden change in work schedule can also lead to violations that result in further incarceration.

Electronic monitoring disproportionately affects people of color, who already comprise more than 60 percent of people in correctional and detention facilities. Michelle Alexander, author of The New Jim Crow, warns that this new age of e-carceration is tantamount to the “Newest Jim Crow.” As mass incarceration continues to affect people of color disproportionately, the growth of electronic monitoring from just 53,000 units in use in 2005 to well over 100,000 now, will also amplify the impact on e-carceration in vulnerable communities.

Curiously, studies show that black prisoners are less likely to accept electronic monitoring over prison. Perhaps this is due to skepticism about the success rates for participation or fear that a faulty signal could extend a sentence. And yet, even with this attempt to avoid it, black people are subjected to electronic monitoring at a rate grossly disproportionate to their share of the population. In Cook County, Illinois, for instance, Black people make up only 24% of the county’s population yet represent 70% of those who are on electronic monitors. This is part of the reason why the Center for Media Justice calls for an end to electronic monitoring.

Electronic monitoring of juveniles has been criticized for undermining the rehabilitative purpose of the juvenile justice system.

Problems with reading comprehension or language translation can make it difficult for monitored people to understand and comply with the strict rules that govern e-carceration. A person’s electronic monitoring is governed by individual supervisors, who can change frequently. Supervisors often have different rules, and some rules are subjective and prone to bias.

It’s often unclear when movement will be permitted or for what purpose. Requests for movement for family, parenting, or community activities are often refused or not approved in a timely manner. Stringent rules can lead to jail time and increased costs due to technical violations. For example, someone who comes home late from work because the bus was late can be sent back to prison. To make matters worse, call center operators who handle all communication between people using electronic monitoring devices and their parole officers are frequently slow to answer the phone and often fail to record pre-arranged movement.

Like all technology, electronic monitoring devices are imperfect. They are subject to technical failures and false monitor alarms. For example, GPS tracking devices can lose signal, which can trigger an alarm and an arrest warrant. Electronic monitoring devices must be plugged in twice a day for an hour at a time, and some batteries don’t last the 12 hours they’re supposed to.

GPS location traffic data from electronic monitoring devices often ends up in a database under control of the state and a private vendor. When maintained by law enforcement, this circumvents legal safeguards (like search warrants) for electronic location data. Whether it’s controlled by the state or by a private vendor, it’s often unclear what the restrictions are for access to that data, or what the regulations are for storage, use, information security, and retention. This runs the risk of private companies selling or sharing the information for a profit, or failing to adequately secure it from theft.

Who Sells Electronic Monitoring Technology

Companies that make or have made electronic monitoring devices include SuperCom, USA Technologies, Sentinel Offender Services, owned by Robert Contestabile, Attenti (formerly 3M), owned by Apax Partners, BI Incorporated, owned by private prison group GEO Group (the sole provider for ICE), and “Libre” by Nexus, a company that pays the cash bonds to release immigrants who are in detention. Another EM company is Satellite Tracking of People (STOP), which, is owned by Securus Technologies (one of the largest prison phone providers), which in turn is owned by an investment firm, Platinum Equity).

Some states contract with more than one electronic monitoring company. For example, they may rent GPS tracking devices from one company but rent the SCRAM devices used to detect blood alcohol from another firm.
