We have many instructors who, unfortunately, are involved in a non-fault car accident and their claim has gone 50/50. Ultimately, this has affected their insurance premium and payout, causing a short term loss and extra expenses in the long term on their insurance premium.

Here are some examples:

Instructor’s car gets hit from behind at traffic lights on driving lesson (low impact 5-10mph), the defendant said to the insurers that the pupil put the car in reverse.

Instructor’s car gets hit from behind while stationary, waiting on a hill. The defendant said the pupil rolled back into them.

In both cases, which are meant to be straight forward, these have gone 50/50 because the insurance companies don’t care. With the volume of accidents happening daily, the insurance companies often don’t spend much time defending their clients (you – the instructor) or providing the right advice to prevent this type of fraud happening to you.

With the above types of cases, they often go to a 50/50 settlement if you don’t get all the facts right at the beginning. Building a good solid case at the beginning stops these sort of things happening later.

Instructors we have helped in the past:

Amina Begum: Accident on a roundabout with an AA vehicle towing a car. This was going to be a 50/50 case. With the use of Photoshop, Google Earth and writing a proper in depth explanation of each type of scenario the case was settled in Amina’s favour.

Ben Hampson: Accident on a double roundabout involving poor lane discipline from defendant turning right. Ben knew his pupil’s positioning was correct but without dash-cam footage, it makes this type of accident difficult to prove who was positioned where and who turned into who.

Using photos of the damage to both cars, we went through the possible means of the accident based on the impact areas on each car. After breaking down all potential eventualities in layman’s terms for the insurers, we overcame the defendants fraudulent claim that Ben’s pupil was driving incorrectly and settled the case in Ben’s favour.
